Key Point

Use and Scope

Xelora is a clarity and reflection app. It is not professional care, diagnosis, medication advice, a crisis hotline, or an emergency service.

Key Point

AI and Safety Limits

AI outputs, summaries, memory, and safety prompts can be inaccurate, delayed, incomplete, or unsuitable for a specific situation.

Key Point

Account Rules

Users are responsible for lawful use, account security, and not uploading content they have no right to share.

Acceptance

Agreement to these terms

These Terms of Use govern access to Xelora, including the web app, mobile surfaces, AI chat, mood and journal tools, guided modules, uploads, and voice or audio features where enabled.

Top
  • By creating an account, signing in, opening the app, or using any feature, you agree to these terms and to the Privacy Policy.
  • If you use Xelora for a company, school, clinic, organization, or another person, you represent that you have authority to do so and that your use is lawful.
  • If you do not agree to these terms, do not use Xelora.
  • By checking the "I agree" box or equivalent acceptance control during registration, you confirm that you have read, understood, and agree to be bound by these Terms of Use and the Privacy Policy. This constitutes a legally binding clickwrap agreement.

Eligibility

Who may use Xelora

Xelora is intended for people who can use a clarity and reflection product responsibly.

Top
  • You must be old enough and legally able to agree to these terms under the laws that apply to you.
  • If you are under the age where you can consent to digital services on your own, use Xelora only with appropriate parent or guardian involvement.
  • Do not use Xelora if your access has been suspended, banned, or terminated unless we give written permission.

Safety Boundary

Xelora is not professional care or emergency support

The app can support reflection and coping routines, but it does not replace real-world help.

Top
  • Xelora is not a licensed therapist, psychologist, psychiatrist, medical doctor, clinician, or provider of healthcare, therapy, legal, or financial services. The app does not establish a doctor-patient relationship, therapist-client relationship, or other professional fiduciary relationship.
  • Do not rely on Xelora for medical diagnosis, treatment plans, clinical assessments, drug dosages, psychiatric advice, or legal or financial decisions. All AI outputs are simulated reflections, not medical or professional records.
  • If there may be immediate danger, self-harm, suicide risk, harm to another person, abuse, overdose, medical emergency, or any urgent crisis, contact local emergency services or an appropriate crisis resource immediately. Do not wait for an app response.
  • Safety prompts, crisis language detection, and urgent-help guidance are protective features, but they may miss risk, misread context, or appear too late.

AI Limits

AI outputs and app-generated content

Xelora may generate chat replies, summaries, reflections, suggested next steps, key insights, sentiment labels, memories, or progress views from the information you submit.

Top
  • AI and automated outputs can be wrong, incomplete, outdated, biased, repetitive, or not suited to your circumstances.
  • You are responsible for checking important information before relying on it, especially for health, safety, legal, financial, employment, or relationship decisions.
  • Do not treat AI outputs as professional advice, diagnosis, treatment, medication guidance, emergency instructions, or proof that a human reviewed your situation.
  • The app may store limited context or memory to support continuity, but memory features are not a medical record and may be incomplete or later removed.

Accounts

Account security and accurate information

Your account controls access to sensitive reflections.

Top
  • Keep your login credentials, device sessions, and recovery channels secure. Do not share an account unless the product explicitly supports that use.
  • Provide accurate account information and keep it current so authentication, safety notices, support, and account deletion can work.
  • Tell us promptly through the available support path if you believe your account, device, or session token has been compromised.
  • You are responsible for activity under your account unless the activity happened because of a security failure that was not caused by you.

Use Rules

Prohibited use

Do not use Xelora in a way that creates legal, security, safety, or abuse risk.

Top
  • Do not harass, threaten, exploit, impersonate, dox, scam, spam, stalk, intimidate, or encourage harm to yourself or others.
  • Do not upload malware, unlawful content, non-consensual intimate content, graphic harm content, private information you have no right to share, or content that infringes another person's rights.
  • Do not try to bypass rate limits, authentication, subscription controls, moderation, file limits, safety systems, prompts, model restrictions, or other safeguards.
  • Do not use Xelora to generate or distribute instructions for self-harm, violence, abuse, evasion, fraud, credential theft, or illegal activity.
  • Do not use Xelora as a clinical record system, regulated provider workflow, or place to store information you are legally required to protect under a professional duty unless we have signed a separate written agreement that permits that use.
  • You agree to defend, indemnify, and hold harmless Xelora, its creators, affiliates, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your content, your violation of these terms, or your misuse of the service.

Content

Your content and the license needed to operate Xelora

You keep ownership of content you submit, but Xelora needs permission to process it so the service can function.

Top
  • You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, format, display, translate, summarize, analyze, moderate, and otherwise use your content as needed to operate, secure, improve, and support Xelora.
  • This license includes permission to process content through configured service providers, including AI, hosting, storage, speech, moderation, analytics, or infrastructure providers where those features are enabled.
  • When you delete content or an account, this license ends for active service use except where retention is needed for backups, security, audit logs, moderation evidence, legal obligations, dispute handling, or other legitimate operational reasons described in the Privacy Policy.
  • You represent that you have the rights and permissions needed to submit your content and that submitting it will not violate law, contracts, confidentiality duties, or another person's rights.

Privacy

Sensitive data, uploads, and privacy

Xelora can involve sensitive personal reflections, mood data, journals, chats, and uploads.

Top
  • Your use of Xelora is also governed by the Privacy Policy, which explains collection, AI processing, service providers, retention, deletion, and user controls.
  • Do not submit information you do not want processed by Xelora or its configured providers, and do not upload third-party information unless you have permission.
  • Xelora account deletion and chat wipe features may remove active product data, but some information can remain temporarily or permanently in backups, logs, moderation records, security records, billing records, or legal archives where permitted or required.
  • No internet service can guarantee absolute security, and you should avoid storing emergency instructions, passwords, financial account details, government IDs, or other unnecessary sensitive data in Xelora.

Access

Availability, free access, and future paid features

The landing page presents core access as free at launch, but features and limits can change.

Top
  • Features may be added, changed, limited, paused, or discontinued, including AI providers, memory, uploads, voice features, mobile features, and free access levels.
  • If paid plans, subscriptions, trials, app-store purchases, or marketplace purchases are introduced, the checkout or store terms shown at purchase will govern price, renewal, cancellation, refund, restoration, and tax details.
  • AI usage, uploads, audio features, and other endpoints may be subject to rate limits, file limits, account limits, geographic limits, provider availability, or abuse prevention controls.
  • We do not guarantee uninterrupted availability, response time, preservation of content, compatibility with every device, or continued access to any free feature.

Enforcement

Suspension, termination, and investigations

We may act when there is misuse, safety risk, legal exposure, or security concern.

Top
  • We may suspend or terminate accounts, revoke sessions, delete or restrict content, limit features, or block access when these terms are violated or risk requires action.
  • We may investigate suspected abuse using account data, logs, reports, uploaded content, and technical signals.
  • We may report or disclose information when necessary to comply with law, respond to valid legal process, enforce these terms, protect users or the public from serious harm, or defend Xelora's rights and security.

Disputes

Mandatory binding arbitration, class action waiver, and 30-day opt-out

Please read this section carefully, as it affects your legal rights under US federal and state law.

Top
  • Any dispute, claim, or controversy arising out of or relating to Xelora, these terms, or their breach, shall be settled by binding, individual arbitration administered by JAMS (or an agreed AAA arbitrator) under its Consumer Arbitration Rules, rather than in court.
  • You and Xelora agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
  • You waive the right to a trial by jury and the right to participate in any class-action lawsuit, class-wide arbitration, or private attorney general action.
  • This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.) and survives any termination of your account or the service.
  • Arbitration Opt-Out Right: You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out within 30 days of first accepting these terms to legal@xelora.app (or the address published on the official Xelora website). Your notice must include your name, account email, and an unequivocal statement that you opt out of arbitration.

Rules regarding intellectual property, user content immunity, and legal jurisdiction.

Top
  • DMCA Copyright Policy (17 U.S.C. § 512): If you believe that any content hosted on Xelora infringes your copyright, send a written DMCA takedown notice to our designated agent containing the physical signature, identification of the copyrighted work, description of infringing material, and contact details.

  • Governing Law & Forum: These terms and any non-arbitrable disputes shall be governed by and construed in accordance with the laws of the State of Delaware (or the state of incorporation/operation), without regard to its conflict of law principles.

Legal Limits

Disclaimers, liability, and changes

These limits apply to the maximum extent permitted by law.

Top
  • Xelora is provided on an as-is and as-available basis with all faults and without warranties of any kind. We disclaim all warranties, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and course of dealing.
  • We disclaim all liability for any mental health deterioration, emotional distress, self-harm, suicide, psychological injury, personal injury, or death. Xelora is a conversational simulator, not a medical or clinical safety device. You use the service at your own sole risk.
  • To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for decisions made in reliance on AI, or for data breaches, leaks, server downtime, or loss of content.
  • To the maximum extent permitted by law, our total cumulative liability for any and all claims related to Xelora is limited to the lesser of the amount you paid for the service in the 12 months before the claim, or 50 USD, regardless of the legal theory.
  • Some jurisdictions do not allow certain disclaimers or liability limits, so some limits may not apply to you. Your non-waivable consumer rights remain in effect.
  • We may update these terms as Xelora changes. Continued use after the updated date means you accept the revised terms.

General

Severability, entire agreement, force majeure, and contact

Standard legal provisions that govern how these terms operate as a whole.

Top

  • Force Majeure: Xelora shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond reasonable control, including but not limited to natural disasters, acts of war or terrorism, pandemics, epidemics, government orders or regulations, internet or infrastructure failures, power outages, labor disputes, cyberattacks, or third-party service provider outages.
  • Assignment: Xelora may assign or transfer these terms, or any rights or obligations hereunder, without restriction. You may not assign or transfer these terms without prior written consent.
  • No Waiver: The failure of Xelora to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
